ESIC Unemployment Benefits: Do not panic if you have lost your job. Under the Rajiv Gandhi Shramik Kalyan Yojana, 50% of the income is received as unemployment allowance in the form of financial assistance.
Many people have lost their jobs during the Coronavirus period. According to CMIE, the average unemployment rate in India as of June 21 is at 10.6 percent. On June 7, unemployment had reached 12.99 percent. However, in the last two weeks it has come down a bit. If we talk about last year, then in the nationwide lockdown, unemployment had crossed 24 percent. In such a situation, if you have also become unemployed then there is no need to panic. You can get unemployment allowance under a scheme of ESIC (RGSKY Benefits).
RGSKY (Unemployment Allowance Scheme)
The Corporation introduced Unemployment Allowance Scheme (Rajiv Gandhi Shramik Kalyan Yojna) w.e.f. 01.04.05, in pursuance of powers conferred U/s. 19 of the E.S.I. Act, 1948.
Under the Scheme, an Insured Person/Insured Woman going out of employment after being insured three or more years due to closure of the Factory/Establishment, involuntary retrenchment or permanent invalidity, are entitled to :
Unemployment Allowance equal to 50% of the wage for a maximum period of two years.
Medical care for self and family from ESI Hospitals/ Dispensaries during the period IP receives unemployment allowances.
Vocational training provided for upgrading skills- Expenditure on fee/ travelling allowance borne by ESIC
What is RGSKY?
This scheme is Rajiv Gandhi Shramik Kalyan Yojana (RGSKY). This scheme giving unemployment allowance is being run since 2005. In this, if a person is covered under the ‘Person Employee State Insurance Scheme’, then he is given financial help when he becomes unemployed. Under this, 50 percent of the person’s income is given as unemployment allowance in the form of financial assistance. Let us tell you that this assistance is given for a maximum period of 2 years.
There are some conditions along with the unemployment allowance received under this scheme. If the person is standing on those Sharon then only this allowance will be received. Let us know what are these conditions-
Under the ESIC scheme run by the Union Ministry of Labor and Employment, the benefit of Rajiv Gandhi Shramik Kalyan Yojana is given. This scheme is for persons already covered under ESIC.

Key point of RGSKY
Only those people get the benefit of this scheme who are insured under ESI Act at the time of loss of their job in form of closure or retrenchment of concerned company.
The person’s minimum contribution for a period of 5 years under the ESI scheme at the time of loss of their job.
This unemployment allowance shall be stopped when insured person again get the job.
The unemployment allowance shall not be covers maternity, sickness benefits or temporary disablement benefits at same time.
The amount money given as an unemployment allowance define under section 61 of ESI Act (Employee’s State Insurance) 1948.
This allowance is payable to insured person approximate period of 1 year.
The amount money under unemployment allowance will be 50 % of last 1 year salary/income.
In this scheme applicant person and his dependent family members are take the benefit of medical treatment under ESI Act for continues period of one year from the date of last employment.
The amount of unemployment allowance shall be stopped when the insured person gets the job or attain the retirement age i.e 60 years.
Under this Scheme, the applicant can get a daily rate of allowance and medical treatment for him/her and their dependent family members within the period of unemployment up to 2 years
Eligibility to get the benefits of Unemployment Allowance
Insured person must be unemployed after the month of April 2005.
Applicant person can avail the benefit of this scheme after minimum the period of one month fromthe date of loss of their job.
Under this scheme only those peoples are covered who are contribute at least 2 years under the ESI Act at the time of loss of their job.
In this scheme applicant must applied or claim the unemployment allowance within 1 years of unemployment.
The Unemployment allowance is provided for a period of 24 months in alifetime as an employee or until he/she attain the age of 60.
Applicant only can get the financial help and medical facility under this scheme.
Disqualification under this scheme:-
Lose their employment due to union strike or employee strike.
Voluntary retirement
Applicant attain the age of 60 years or above.
Applicant loses their regular job due to any dispute or committing any criminal offence.
When person get new job then he/she will be disqualified from this scheme.

Under the ID Act, if the ESIC insured loses his job due to retrenchment or factory closure, he is eligible for unemployment allowance.
The insured person has to apply for unemployment allowance at the branch office. The branch office scrutinizes the claim of this application and forwards the application to the SRO or RO. Only after this, the person gets the allowance.

The applicant can claim for Unemployment Allowance in between 3 months from the date of lose their job.
The applicant can applied to the proper channel or concerned Branch Officei.e ESI corporation office in the Form -(US-1) attached with documentary proof in Form (UA-2) showing their unemployment.
The certificate is given by the concerned inspector of factories prescribed under factories act, commissioner under labour workmen compensation act or any other concerned authority.
Mode of Payment of under this scheme:-
The Unemployment allowance is paid through by Account Payee Cheque.
If the applicant will be died in this period of 2 years than unemployment allowance is continue for completion of 2 years and payable to his/her nominee.
